Terms of service.

1. Scope
These Terms and Conditions (“AGB”) apply to all services, products, and digital offers provided by Fatima Sami (“Provider”) via the website www.fatimasami.com. By purchasing or booking any tier, program, or consultation, the client (“Customer”) accepts these Terms and Conditions as binding.

2. Nature of Services

  • All tiers and programs offered are for educational and consulting purposes only.

  • No tier guarantees or promises specific results, growth, reach, engagement, or other measurable performance on LinkedIn or any social media platform.

  • Tier Three (“Executive Visibility Partner”) includes the creation and posting of content in the Customer’s voice. However, the Provider does not guarantee any performance, reaction, or outcome of such content.

  • The Provider expressly excludes any liability for the commercial success or failure of the Customer’s brand, company, or personal positioning.

3. Binding Purchase

  • All purchases are binding once completed.

  • A right of withdrawal (Widerrufsrecht) according to German law may apply only if the statutory requirements are met. Customers expressly agree that performance of the service may begin before the withdrawal period ends, which limits or extinguishes the right of withdrawal (§356 Abs. 4 BGB).

  • No refunds are offered unless required by law.

4. Rescheduling and Cancellations

  • Cancellations of booked sessions must be made at least 24 hours before the scheduled time.

  • Rescheduling is permitted up to 24 hours before the scheduled time.

  • If the Customer cancels later than 24 hours before the session or does not attend, the session counts as delivered.

5. Customer Responsibilities

  • The Customer is responsible for implementing strategies, recommendations, and learnings.

  • The Provider cannot be held liable if the Customer does not apply the content or does not achieve desired outcomes.

  • The Customer is responsible for ensuring all information and materials shared are accurate and legally permissible.

6. Information and Data

  • All Customer information will be treated with utmost care and confidentiality.

  • Data will not be shared with third parties without explicit consent, unless required by law.

7. Liability Disclaimer

  • The Provider is not liable for indirect damages, lost profits, or business interruptions.

  • Liability is limited to cases of intentional misconduct or gross negligence.

  • Any further liability, particularly for outcomes on social media platforms, is excluded to the extent permitted by law.

8. Intellectual Property

  • All materials, templates, and frameworks provided by the Provider remain the intellectual property of the Provider.

  • The Customer receives a personal, non-transferable license for use.

9. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the Federal Republic of Germany.

  • Place of jurisdiction is Berlin, unless mandatory statutory provisions apply.

10. Severability Clause
If any provision of these Terms is or becomes invalid, the remaining provisions shall remain unaffected.
